Requirement : Be Available For Work
In order to be eligible for UI you must not be too ill or injured to work. You must be able to legally work in the United States and you must not be on vacation or otherwise unavailable to accept work. Also, you must not unreasonably refuse work if offered.Acceptable reasons for refusing work include but are not limited to:
Requirement 6: If you quit your job, you must have quit your job for a good reason, and if you were terminated, you must not have been terminated because of misconduct at work.
This will be divided into two sections:

Unemployment Insurance Benefits where the employee voluntarily left their job
What If My Disability Lasts Longer Than 52 Weeks
If your disability is expected to or does continue past one year, you may be eligible for Social Security Disability Insurance or Supplemental Security Income , depending on the type of disability and how severe it is. In addition, some employers provide private insurance, called Long Term Disability Insurance to their employees with long-term disabilities. If you believe you may be covered by LTD, you should contact your employer to find out about benefits and eligibility and to request a copy of the Summary Plan Description.
What If I Dont Have Money In My Base Period Because I Was Unemployed Before I Became Disabled
There are two rules that may help you if you do not have earnings in your base period due to unemployment:
First, if you have an unexpired claim for unemployment insurance benefits when you are seeking SDI, then you may use the base period you used for your unemployment insurance claim.
Second, if you were unemployed during any quarter of your base period meaning out of work for 60 or more days and looking for work you may disregard that quarter and begin your base period three months earlier than the period set forth in the above chart. For each quarter you were unemployed, you may go back another quarter.

How Are The Amount Of Sdi Benefits Calculated
In most cases, SDI takes all the wages that were earned over a workers base period as described above, then divides up the base period into four separate quarters. SDI then takes the quarter where you were earning the most money and divides all the money you earned in that quarter by 13, because there are roughly 13 weeks in a quarter. Then SDI takes that number and pays 55% of it every week.So for example, Joan made $9,250 the first quarter of her base period, $9,750 the second quarter, $10,250 the third quarter, and $10,750 the fourth quarter. SDI takes the quarter where she earned the most money and divides that by 13. Here we get $826.93. SDI then pays 55% of that figure rounded up to the nearest dollar or $455 In this example, Joans weekly SDI benefit would be $455 for each week she is eligible for SDI.
There are some situations where an SDI claimant can utilize a different quarters earnings that is not in their base period in order to obtain a higher highest earnings quarter and thus a higher weekly SDI payment. These situations include:

How Long Will I Receive Sdi
You will receive SDI benefits for as long as you remain disabled, as defined, up to a maximum of 52 weeks. However, in some cases a person who is otherwise qualified might not receive a full year of SDI because they do not have enough money in their account for a full year of benefits. You will receive a statement from the EDD when you apply telling you how much money is in your reserve account.
How Do I Apply For State Disability Insurance Benefits
Go to the Employment Development Departments Website here and either fill out the online application or request a paper copy. The application is four pages long. You should fill out the first two pages of the application, otherwise known as DE 2501, and then give the half-filled out application to your medical provider. Ask them to fill out the remaining two pages, otherwise known as DE 2502. When you have a completed and signed application make a copy of it and mail the original to the Disability Insurance Office nearest to where you live. Do this no earlier than 9 days after you become disabled but no later than 49 days after you become disabled. A list of State Disability Insurance Offices is listed below:

Timing Of Base Period

Date Claim Filed
Because the state uses your highest-paid quarter of your base period to calculate your weekly payment, the date you file your claim can affect your benefits amount. You can use this to your advantage by choosing the date that will give you the base period with the highest wages, but you must file a claim with EDD within seven weeks of becoming unable to work.

How Much Will I Receive From Sdi
Your benefit amount is calculated based on the amount of earnings you had in the highest-earning quarter of your base period, and is about 60-70 percent of your regular earnings. In 2018, the maximum amount of SDI you can receive is $1,216 per week. SDI payments are processed every two weeks.
The entire amount you receive in SDI benefits from a single claim may not exceed the total amount of wages you earned during your base period.

How To Apply For Paid Family Leave
You can apply for Paid Family Leave at the Employment Development Departments Website or you can order an application for Paid Family Leave, otherwise known as form DE 2501 F from the Employment Development Department. You will need to fill out your portion of the application and have your loved ones medical provider fill out their portion. Both you and your medical provider will need to sign the application under penalty of perjury. When you have a completed application make a copy of it and mail the original to the Disability Insurance Office nearest to your home.

What To Expect After You Have Filed For Disability
Once we receive your completed claim application, we will determine your eligibility. You can expect this process to take up to 14 days.
Note: Processing time may vary depending upon the claim. If your claim is incomplete or requires additional information, confirming eligibility can be delayed.
During this time, we will send you a Notice of Computation to inform you of your potential weekly benefit amount based on the wages you earned in your base period.
Receiving this notice does not confirm your eligibility to receive DI benefits.
If Im Injured On The Job Am I Eligible To Collect Sdi
In general, no. If youre injured on the job and cannot work, you should qualify for temporary income replacement through Workers Compensation.
There are two exceptions. First, if the amount of money paid to you from your Workers Compensation benefits is less than what SDI benefits would pay, then you may make a claim for SDI to cover the difference. Second, if there is a delay in your Workers Compensation application you may apply for SDI benefits until the dispute is settled.
If your Workers Compensation claim is later approved, you will have to pay back the SDI you received so that you dont get double benefits for the same period of time. If you receive both Workers Compensation and SDI benefits for the same injury, be sure that you keep the EDD updated on your Workers Compensation claim and the Workers Compensation carrier updated on your SDI claim, so that you can avoid an overpayment.

How To Apply For Unemployment Insurance
You do not need to visit an office of the Employment Development Department in order to apply for Unemployment Insurance. You can apply for UI in three different ways. However, for a faster response from EDD it is recommended that you apply online. The three different ways are:
Typically, after an application for Unemployment Insurance Benefits is properly submitted a telephone interview will be scheduled with the claimant. If that happens, you want to be available for the telephone interview and answer all questions truthfully. If you qualify for Unemployment Insurance you should begin receiving checks within two weeks.
What Is State Disability Insurance
California State Disability Insurance is a worker-funded program that provides partial wage replacement when a worker needs to take time off work due to pregnancy, childbirth, or a non-work related serious illness or injury. The State Disability Insurance program is administered by the Employment Development Department .

My Employer Offers Private Short
Typically, yes. If the benefits are integrated, the EDD will pay you an amount for SDI, and your employer or its insurance carrier will pay you an additional amount to cover some or all of the difference between SDI and your full wages.
If you dont know whether your employer integrates benefits with the EDD, ask your HR department or manager for information.
Social Security Disability Statistics In California
California’s approval rate for disability benefits is about the same as the national average for awarding benefits. After filing the initial application, almost 37% of disability applicants are approved to receive benefits. At the reconsideration level , about 12% of the previously denied cases are approved. And at the disability hearing level , in 2019, 56% of the previously denied cases were approved for benefits .

How Will I Receive My State Disability Insurance Payments
You will be able to select your payment option when you file your claim.
EDD Debit Card: If eligible, benefit payments are issued on the EDD Debit Card within 24 hours of processing your certification and immediately available to you.
EDD Checks by Mail: If eligible, benefit payments are issued by EDD check within 24 hours of processing your certification. Allow 7 to 10 days for delivery of checks in the mail.
Filing A Claim For Sdi
You can file a claim online at the SDI Online page of EDD’s website or you can file Form DE 2501, Claim for Disability Insurance Benefits, which you can request be mailed to you from the EDD website. You have only 49 days from becoming disabled to file a claim. You’ll also need to ask your doctor to fill out a medical certificate of disability or register online and certify your disability online.
If the EDD approves your application for SDI benefits, you will be sent a notice of eligibility, which will include an estimate of your weekly benefit amount.

How Other Benefits Affect Your Sdi Benefit
Sick pay or PTO. Paid sick time, PTO, or holiday pay that you receive while receiving SDI will be subtracted from your SDI benefit amount, as will wages for part-time work . You can ask the EDD to “integrate” the SDI benefit with your sick pay or PTO, however. If your employer agrees, your employer can pay you just enough sick time or PTO so that, when combined with SDI, you will be receiving the same amount as your normal salary or wages. On your application form, you write “Integrated Benefits” for the type of pay you are receiving from your employer.
In addition, you may receive sick time or PTO for the first seven days of your disability, since SDI will only start paying you on the eighth day.
Paid vacation. Receiving paid vacation benefits will not affect your SDI payment.
Social Security disability. If you apply for and are approved for Social Security disability benefits, the state may subtract your disability benefits from your SDI payment.
Eligibility For Other Public Benefits
For those who are newly unable to work, California has a short-term disability insurance program that provides eight to ten weeks of benefits for those who are ill or injured and unable to work. The SDI benefit is 60-70% of your normal wages. California’s paid family leave program also provides up to six weeks of paid leave. California residents who are approved for SSI are automatically approved for Medicaid benefits as well. Social Security will enroll you in Medicaid automatically when it approves your SSI benefits.
California residents who receive SSI are also eligible for CalFresh benefits . Previously, California SSI recipients were paid a higher state supplementary payment instead of food stamps.
I Have Some Vacation And Sick Days May I Use My Vacation Or Sick Days At The Same Time I Receive Sdi
You may receive vacation pay and SDI at the same time.
You may not receive full sick pay and SDI at the same time. You may receive partial sick pay to cover some or all of the difference between SDI and your full wages. If you are uncertain, you should report to EDD any pay you receive from your employer.
