What Are Qualified Health Plans
- COBRA: You must pay more than 50% of COBRA premiums. If COBRA eligibility ends, HCTC eligibility also ends until you enroll in another qualified health plan.
- Spouseâs Employer Health Plan: You may enroll in group coverage through spouseâs employer. Your spouse must pay more than 50% of the insurance premium. However, the monthly payment option is not available under this type of plan.

For An Eligible Employer Who Sponsors A Health Reimbursement Arrangement A Health Flexible Spending Arrangement Or A Qualified Small Employer Health Reimbursement Arrangement Are Contributions To The Hra Health Fsa Or Qsehra Included In The Qualified Health Plan Expenses
The amount of qualified health plan expenses may include contributions to an HRA , or a health FSA, but does not include contributions to a QSEHRA. To allocate contributions to an HRA or a health FSA, Eligible Employers should use the amount of contributions made on behalf of the particular employee.
Special Rule For Disability Insurance Coverage
The preamble to the proposed regulations requested comments on whether there should be limited exceptions to the general rule in the proposed regulations, including whether there should be an exception for a provision that has the effect of a waiver of premium in the case of disability. All of the commenters that addressed the issue of payment of premiums for disability insurance from a plan recommended an exception for disability insurance arrangements that replace retirement plan contributions, describing these arrangements as having the same effect as a waiver of premiums in the case of disability. For example, commenters described an employer’s general disability program that not only provides for wage replacement, but also provides for the purchase of insurance to make payments to a qualified plan in the event of a participant’s disability that are intended to replace the contributions that would have been made if the participant was not disabled. These commenters requested that the regulations provide that a participant not be currently taxable on the premiums paid by the plan for this type of disability coverage. Similarly, they recommended the participant not be taxed when payments from the disability insurance contract are allocated to the participant’s account after the participant becomes disabled. These comments pointed out that the payments would be taxable when benefits are ultimately distributed from the plan.

Deductions For Qualified Unreimbursed Healthcare Expenses
However, you may be able to deduct some of your premiums if you purchase health insurance on your own using after-tax dollars. For the 2020 and 2021 tax year, youre allowed to deduct any qualified unreimbursed healthcare expenses you paid for yourself, your spouse, or your dependentsbut only if they exceed 7.5% of your adjusted gross income .
AGI is a modification of your gross income. It includes all your sources of incomewages, dividends, spousal support, capital gains, interest income, royalties, rental income, and retirement distributionsminus any number of allowable deductions from your income, including retirement plan contributions, student loan interest payments, losses incurred from the sale or exchange of property, early-withdrawal penalties levied by financial institutions, among others.
This is a lower amount than in 2019, in which any healthcare costs that were greater than 10% of AGI were eligible for the deduction. In 2017 and 2018, the cutoff was also 7.5%.
Expenses that qualify for this deduction include premiums paid for a health insurance policy, as well as any out-of-pocket expenses for things like doctor visits, surgeries, dental care, vision care, and mental healthcare. However, you can deduct only the expenses that exceed 7.5% of your AGI.

Who Qualifies For Medical Expense Tax Deductions
The Internal Revenue has two critical eligibility rules for people who dont own a business:
- A standard deduction is $12,400 for singles, $18,650 for heads of household and $24,800 for married joint filers for the 2020 tax return. If your tax deductible health insurance costs dont exceed those limits, its best to go with a standard deduction rather than itemize your health care deductions.
- Your health care costs must exceed 7.5% of your adjusted gross income for 2020 tax filings. The AGI is what you earn in wages, investments and other sources minus things like alimony and student loan interest. You can find your adjusted gross income on line 37 of Form 1040. Note: starting with 2021 taxes, medical costs will have to exceed 10% of your AGI.
So, the first question to answer is: How many eligible health care costs do you have? If your health care costs are less than the standard deduction amount, you should take the standard deduction instead.
Chris Peterson, tax manager at CB Smith & Associates, said most people take the standard deduction rather than itemize health care deductions because they dont exceed the standard deduction level.

Can I Cancel My Health Insurance Without A Qualifying Event
You can cancel your individual health insurance plan without a qualifying life event at any time. But it is important to remember that once you cancel your policy, you cannot enroll again until the next open enrollment period. Do I Need Qualified Health Coverage
Yes. In order to select certain lower and presumably cheaper levels of No-Fault PIP medical benefits, you or a family member will need to have health insurance that meets the requirements of qualified health coverage under the new Michigan No-Fault law.
These are the relevant coverage levels and requirements:
- The $50,000 coverage level for drivers enrolled in Medicaid requires that the drivers spouse or relative who lives in the same home have QHC, be enrolled in Medicaid or have his or her own No-Fault auto insurance policy. ) That means that if a drivers spouse or family does not have Medicaid or No-Fault or insurance, through a private plan or through Medicare, that meets requirements of qualified health coverage under the new Michigan No-Fault insurance law, then the driver cannot select the $50,000 level.
- The total opt-out of No-Fault PIP medical benefits for a driver who has Medicare requires that his or her spouse or family member that lives with the driver either have qualified health coverage that is required under the new Michigan No-Fault insurance law or have his or her own No-Fault auto insurance policy. )

An Eligible Employer who sponsors a self-insured group health plan may use any reasonable method to determine and allocate the health plan expenses, including the COBRA applicable premium for the employee typically available from the administrator, or any reasonable actuarial method to determine the estimated annual expenses of the plan.
If the Eligible Employer uses a reasonable actuarial method to determine the estimated annual expenses of the plan, then rules similar to the rules for insured plans are used to determine the amount of health plan expenses allocated to an employee. That is, the estimated annual expense is divided by the number of employees covered by the plan, and that amount is divided by the average number of work days during the year by the employees . The resulting amount is the amount allocated to each day of qualified wages. Adjustments should be made for employee after-tax contributions.

May An Eligible Employer That Averaged 100 Or Fewer Full
Yes. An Eligible Employer that averaged 100 or fewer full-time employees in 2019 may treat its health plan expenses paid or incurred, after March 12, 2020, and before January 1, 2021, during any period in a calendar quarter in which the employers business operations are fully or partially suspended due to a governmental order or a calendar quarter in which the employer experiences a significant decline in gross receipts as qualified wages, subject to the maximum of $10,000 per employee for all calendar quarters for all qualified wages. Eligible Employers may treat health plan expenses allocable to the applicable periods as qualified wages even if the employees are not working and the Eligible Employer does not pay the employees any wages for the time they are not working.
Example 1: Employer Y averaged 100 or fewer employees in 2019. Employer Y is subject to a governmental order that partially suspends the operation of its trade or business. In response to the governmental order, Employer Y reduces all employees hours by 50 percent. It pays wages to the employees only for the time the employees are providing services, but Employer Y continues to provide the employees with full health care coverage. Employer Ys health plan expenses allocable to wages paid during the period its operations were partially suspended may be treated as qualified wages for purposes of the Employee Retention Credit.
