What does the NDIS mean to you?

Interviews with disability service providers in the three sites will provide information on

    How care service organisations are responding and adapting to the new market context, and the implications for care outcomes

  • The comparative approach will enable the research to investigate how governance and market architectures are able to manage different types of market variation or service issues. Each of the three sites have location-specific governance and funding arrangements.

    The social network analysis survey will be distributed online once a year in all three sites, using registered provider lists available through the National Disability Insurance Agency.

    What Does The Scheme Do

    The NDIS works with you to identify the supports you need to achieve goals in many aspects of your life. This may include independence, involvement in your community, education, employment and health and wellbeing.

    It provides greater choice and control over how and when you receive your supports and ensures you receive the support you need over your lifetime.

    It also focuses on early intervention where getting early support can reduce the impact of disability for you or your child.

    Can I Access The Ndis

    You need to meet the following requirements:

    • have a permanent and significant disability that affects your ability to take part in everyday activities
    • be aged less than 65 when you first access the scheme
    • be an Australian citizen, a permanent resident or a New Zealand citizen who holds a Protected Special Category Visa
    • live in an area where the NDIS is available.

    Analysing Service Delivery Strategies

    Checklist:

    • Do you conduct analyses to find out how services are being used by people with disabilities, and if there are any barriers to full participation?

    The;National Disability Insurance Scheme is a new way of providing support for people with permanent and significant disability. They may pay for supports relating to healthcare, social life or employment. To participate, you need to be under 65 and meet residency requirements.     Funded Hearing Services Under The National Disability Insurance Scheme

    In general, the NDIS does not fund services that are available to NDIS participants through the Hearing Services Program.

    The NDIS will fund reasonable and necessary supports that are not available to a participant through the HSP. It will also fund hearing services for participants who are not eligible for the HSP.

    The NDIS may also fund additional supports for NDIS participants such as Auslan training and interpreting, and assistive technology and devices like flashing alarms.

    Will My Childs Plan Be Regularly Reviewed

    Your childs NDIS plan will be reviewed regularly, usually every 12 months. In a scheduled review, you and your NDIS representative can check the plan is still meeting your childs needs. You can also change your childs goals if you need to and adjust supports as your childs circumstances change.

    Identifying A Risk Assessed Role

    Registered NDIS providers are responsible for identifying which roles are risk assessed roles, and ensuring all workers in these roles have an NDIS worker screening clearance or an acceptable check under the transitional and special arrangements.

    A risk assessed role:

    • is a key personnel role of a person or an entity as defined in s 11A of the National Disability Insurance Scheme Act 2013
    • involves the direct delivery of specified supports or services to a person with disability
    • is likely to require more than incidental contact with people with disability, which includes:
    • physically touching a person with disability; or
    • building a rapport with a person with disability as an integral and ordinary part of the performance of normal duties; or
    • having contact with multiple people with disability as part of the direct delivery of a specialist disability support or service, or in a specialist disability accommodation setting.

    For the purposes of determining whether the normal duties of a role will require more than incidental contact with a person with disability, contact includes physical contact, face-to-face contact, oral communication, written communication and electronic communication.

    How does the NDIS work for providers?

    NDIS behaviour support practitioners develop written plans in a document, and upload them;into the NDIS Commission Portal using the specialist behaviour support providers own template. NDIS behaviour support practitioners can also download and fill out the NDIS Commission templates:

    The Disability Reference Guide: Its Purpose And Function

    The Disability Reference Guide is a tool for identifying, clarifying and promoting policies to address issues that affect people with disabilities. While the objective of the Guide is to help ensure that federal programs , policies and services maintain or enhance the social and economic inclusion of people with disabilities , much of the Guides content may be of use to other governments, organizations or institutions.

    The Guide can help to ensure that legislation, policies, programs and services:

    • are inclusive of people with disabilities;
    • respect the rights and needs of people with disabilities; and,
    • promote positive attitudes and raise awareness about the needs of people with disabilities in order to prevent unintended negative outcomes.

    Electing to use the Guide will help employees to:

    • systematically assess and address the impacts of all initiatives on people with disabilities;
    • obtain a more nuanced understanding of the multi-dimensional challenges that impact people with disabilities;
    • build partnerships across government departments, and with NGOs and other stakeholders that work with and represent people with disabilities; and,
    • act as a resource in the creation of policies and programs that reflect of the rights and needs of people with disabilities.

    Measuring Impacts On People With Disabilities

    Checklist:

    • Are you using qualitative as well as quantitative indicators to evaluate the impact of policies and programs on people with disabilities?

    • Have indicators been included throughout the evaluation framework to assess short-, medium- and long-term impacts?

    • Have you included indicators that will assess whether the policy or program has contributed to full participation, equality of opportunity, opportunities for independent living and economic self-sufficiency for people with disabilities?

    Examples of such indicators could include whether the policy or program will:

    • provide people with disabilities with increased opportunities for social, economic and civic participation;
    • reduce disparities for people with disabilities with regard to income, employment, health, housing, education, transportation and information; and
    • help people with disabilities overcome barriers to self-sufficiency and independence .
    • Are beneficiaries passive recipients or does the process enable them to take part in decision-making processes?

    • Do your evaluation mechanisms measure whether the policy or program creates any direct or indirect obstacles to the full participation of persons with disabilities? For example:

    • lack of supports for disability-related costs ;

    • physical accessibility; and,
    • accessible service delivery.

    Continuity Of Supported Transport Services Until December 2023

    On 10 December 2018, the Disability Reform Council committed to involving participants, parents, providers and schools in further development work to identify how supported school transport can be provided to students with disability, either within the NDIS or alongside the scheme. Disability ministers noted the importance of incorporating the expertise of the existing sector in the work ahead and there will be opportunities for future engagement in this work.

    While development work is undertaken, supported school transport will continue to be delivered by state and territory governments until 31;December 2023.

    Your Rights Under The Scheme

    If the agency says you can get care and support to help with your disability, you have the right to:

    • get the reasonable and necessary supports you need to meet your goals
    • have choice and control over the way in which your supports are delivered
    • have a support person help you deal with staff at the agency.

    What Checks Do Workers Providing Ndis Supports And Services Need

    What the NDIS means to me: People with disability

    Registered NDIS providers delivering supports and services to NDIS participants must comply with the National Disability Insurance Scheme Rules 2018. This means that registered NDIS providers must ensure that workers in risk assessed roles have either an NDIS worker screening clearance or an acceptable check under the transitional and special arrangements.

    Under the transitional and special arrangements, a registered NDIS provider may allow a person to work in a risk assessed role in a state and territory if the person has a check or clearance that is acceptable under the arrangements for that state or territory. If a worker has an acceptable check in one state or territory, this is not portable to another state or territory. This means that workers of registered NDIS providers delivering services and supports to people with disability in a number of states or territories must have an acceptable check in each state or territory in which they work.

    Ethics Consent And Permissions

    The research has ethics approval from the University of New South Wales Human Ethics Committee . All participants are required to sign a consent form prior to interviews agreeing to recording and use of the data in publications and conference presentations. Survey participants consent to participation through an online checkbox.

    Australian Government Response To The Joint Standing Committee On The National Disability Insurance Scheme Progress Report: General Issues Around The Implementation And Performance Of The Ndis

    The Joint Standing Committee on the National Disability Insurance Scheme progress report: General issues around the implementation and performance of the NDIS covers events from 1 July 2017 to 31 December 2018, and provides an overview of activities relating to National Disability Insurance Scheme implementation, performance and governance, as well as outlining the Committees activities during the period. The progress report explores issues raised in evidence and considers potential future areas of the inquiry. The second progress report of the committee was released in March 2019.

    The 2019 progress report has made 18 recommendations to the NDIA which focus on participant experience, transitional arrangements, disability workforce and NDIA engagement with the disability sector.

    The Australian Government recognises the ongoing work of the Committee in reviewing the national implementation of the scheme and welcomes the opportunity to address issues to ensure the NDIS is rolled out effectively and sustainably.

    Practices Proposed To Be Prohibited

    The NDIS Commission has an important role in assisting the States and Territories to move towards nationally consistent minimum standards as set out in section 181H of the NDIS Act . The Practices proposed to be prohibited document outlines the practices that are either already prohibited or intend to be prohibited by all states and territories. These practices are associated with a high risk of adverse and catastrophic outcomes for NDIS participants. Under section 8, of the NDIS Rules 2018 registered NDIS providers must not use a restrictive practice in relation to a person with disability if the use is prohibited in the state or territory. The publication of an agreed list of prohibited practices will assist in promoting national consistency and improve the quality and safety of supports provided to NDIS participants.

    Correspondence Nominee And Their Role

    In contrast, the role of a correspondence nominee is significantly narrower. Although a correspondence nominee is able to do a range of acts on behalf of a participant under the NDIS, they are not able to do any of the acts by a plan nominee. The acts that a correspondence nominee is able to do include making requests to the NDIA , and receiving notices from the NDIA, on behalf of the participant.

    The matters the correspondence nominee is able to deal with cannot be limited further by the instrument of appointment.

    How appointment of nominee comes about

    A plan nominee or a correspondence nominee may be appointed:

  • at the request of the participant; or
  • on the initiative of the CEO of the NDIA.
  • Appointment at request of participant

    If the participant has requested that a nominee be appointed, the NDIA is to have regard to the principle that a nominee should ordinarily be appointed if the participant requests one.

    If the participant has requested that a particular person be appointed as nominee, the NDIA is to have regard to the following:

  • the principle that the person the participant has requested should ordinarily be appointed;
  • any evidence that indicates that the person might have unduly or improperly induced or influenced the participant to request the appointment; and
  • any conflicts of interest.

    What Does The Ndis Do

    People who meet these requirements are called participants. Carers and family members may also be brought into the NDIS planning process as participants.

    Every NDIS participant has an individual plan that lists their goals. Goals might be meeting new people, volunteering, or getting a job. The NDIS provides reasonable and necessary funding to achieve these goals.

    NDIS participants can manage their own NDIS funds, or they can nominate someone else to control the support they receive, when they receive it and who provides it.     People who are not eligible for the NDIS can still get help to access community and other government services. The NDIS can provide information and help connect people with disability, their families and carers to community and other government services.

    Outcomes From The Consultation

    The consultation received mixed views about the proposed model for supported school transport being delivered under the NDIS, which has indicated that more work is needed to understand these views further.

    The Australian and state and territory governments extend their sincere thanks to everyone who participated in the consultation and shared their views about supported school transport and how it could work under the NDIS. All submissions were carefully considered and they will continue to inform the Australian, state and territory governments understanding of how supported school transport could be delivered into the future.

    Australian Government Response To The Joint Standing Committee On The National Disability Insurance Scheme Final Report: Inquiry Into Ndis Planning

    The Australian Government welcomes the Joint Standing Committee on the National Disability Insurance Schemes final report on the Inquiry into National Disability Insurance Scheme Planning .

    In December 2019, the Committee released an interim report containing 14 recommendations to the National Disability Insurance Agency . The Government responded to this report in February 2020;by supporting seven recommendations, supporting five recommendations in principle, and noting two.;

    The final report was released by the Committee in December 2020 and contains 42 recommendations to improve the participant experience with the NDIS and support the National Disability Insurance Agency to deliver a transparent, consistent and equitable approach to planning.

    The final reports recommendations cover a number of areas including:

    • the experience, expertise and qualifications of planners,
    • the value of informal supports and the role of families, carers and health practitioners in the planning process,
    • the interface between the NDIS and other service systems,
    • the planning experience in particular communities of need, such as those in rural and remote communities, Aboriginal and Torres Strait Islander people and those from Culturally and Linguistically Diverse backgrounds,
    • the timeliness and transparency of the internal review process, and;
    • the availability of advocacy support and access to legal services for people seeking external review of NDIA decision-making.
