What Is Domestic Building Insurance

Domestic Building Insurance is a statutory product, compulsory under relevant building legislation in Victoria for builders carrying out residential building work.

Domestic Building Insurance, or Home Warranty Insurance as it is referred to nationally, covers the homeowner where the contracted building work is incomplete or defective. The insurance responds when the builder has either died, disappeared, become insolvent or has failed to comply with a Tribunal or Court Order.

The cover lasts up to 6 years from completion of the domestic building work or termination of the domestic building contract . Cover is only provided for outcomes relative to a specific dispute resolution process.

From 1 July 2017, registered Victorian builders seeking to purchase insurance from the government backed insurer VMIA must select a licensed Distributor to manage their DBI needs.

NSW Owner Builder Home Warranty insurance scheme is an important part of the NSW government consumer protection strategy. Owner Builder Warranty is designed to provide a safety net to the purchaser of an owner built home or residential construction.

Home Warranty is designed to protect the purchaser , if and when the Owner Builder is unable or unwilling to fulfil their legal obligation to rectify any defective work in an event of death, disappearance or insolvency of contractor/builder/owner-builder.

A Home Warranty Inspection or Owner Builder Inspection is carried out as a final check of works completed by an owner builder as a requirement of home warranty insurance cover. The inspection is to ensure there are no incomplete works or major defects.

Before your builder or contractor starts any kind of residential building work valued at over $20,000 , they must provide you with evidence of cover under the home building compensation scheme specifically for your property.

Providing HBC cover to homeowners for residential projects valued over $20,000, , is compulsory for all licensed builders and contractors.

As a homeowner, its your responsibility to ensure you have received the certificate prior to handing over a deposit, before builder or contractor starts any work under the contract. Homeowners without cover will be unable to make a claim if their builder or contractor become insolvent, disappeared, died or had their licence suspended due to non-complied money order by NCAT or Court.

An icare HBCF Certificate of Insurance should contain:

  • the names of the builder/contractor and homeowner
  • your property address
  • contract price
  • a brief description of the building work.

Make sure you know if you are contracting with an individual, partnership or company and check that the builders or contractors name shown on the certificate provided to you is exactly the same as that on the building contract and the licence issued by NSW Fair Trading.

If you are unsure as to the validity of a Certificate of Insurance you can check the publicly available online Certificates Register, containing all certificates issued by icare HBCF and any other providers.

Building Contracts And Hbc Cover

You must state the cost of HBC cover in your building contract.

Your contract must disclose the total amount of money that you had to pay for the cover .

If you want to charge a margin to arrange the cover, you should not include that in the cost of cover item. You can include it elsewhere in the contract.

If the contract will be signed before you buy the cover, it must include a reasonable estimate of what the cover will cost.

You should also ensure that your contract permits you to adjust the contract price to recover any difference between the actual cost of cover and your estimate. See for example the Variations clause in the NSW Fair Trading Home building contract template for work valued over $20,000.

  • Submit your application for HBC cover through your broker distributor.
  • You need to take out HBC cover for each job and provide the certificate of insurance to your client before you take a deposit or start work. It is an offence to not do this.

    A Popular Misconception Is That The Requirement For Home Warranty Insurance Does Not Apply To Owner

    However, Section 29 of the Act specifically includes owner-builder work as:-

    the reasonable market cost of the labour and materials involved which exceeds the prescribed amount and

    that relates to a single dwelling-house or a dual occupancy.

    In other words, if a home owner carries out owner-builder work and the reasonable market cost of the labour and materials exceeds the sum of $20,000, then the owner-builder is required to obtain Home Warranty Insurance.

    If the owner-builder carries out residential building work that exceeds this value and DOES NOT obtain Home Warranty Insurance at the time of carrying out that work, then the owner-builder may be faced with the difficult situation of having to obtain Home Warranty Insurance after the work has been completed if the owner-builder offers the property for sale within six years from the date the completion of the residential building work.

    The requirement to obtain Home Warranty Insurance after the work has been completed can often create difficulties as a result of the requirements of any of the insurance companies that offer Home Warranty Insurance, such as obtaining of engineers reports and other reports .

    There are also penalties for persons who enter into a Contract for Sale of Land in respect of which land residential building work has been completed which exceeds the prescribed minimum and a Home Warranty Insurance Certificate is not attached to the Contract.

    Builders warranty insurance lasts for up to six years after the builds completion or termination of the building contract. If the contract doesnt state when the work is complete or there is no contract, the builds completion occurs on practical completion.     Unless an earlier practical completion date can be established, it is presumed that this date occurred on the earliest of whichever of the following dates:

  • The date the builder handed over possession of the work to the homeowner.

The Act requires builders and tradespeople to be licensed for the work that they do, and to implement appropriate contracts and insurance before the home building projects commence.

    Clients should be aware of the recent amendments to the Home Building Legislation in NSW, which include:

    • Definition for the date of completion to overcome the previous difficulties faced by owners corporations in establishing the date of completion
    • Exclusion of the Civil Liability Act 2002 for residential building work
    • In respect of building contracts entered into after 1 February 2012, a claim to enforce statutory warranties must be commenced within 6 years for structural defects and 2 years for other defects from the date of completion of the works
    • Insurance claims have an extension period of 6 months for any losses that become apparent in the last 6 months of the period of insurance
    • Beneficiaries must enforce statutory warranties after loss becomes apparent

    Insurance Payout Falls Short

    One aggrieved homeowner, Beverly Loyson, told us her experience with home warranty insurance had led to “extreme emotional and financial damage”.

    Loyson’s building suppliers and installers refused to come back and re-do defective work. The Victorian Building Commission now the Victorian Building Authority agreed the work was unacceptable, but the suppliers hit back, saying they’d only taken orders from the builder who’d hired them.
